O autor analisa os postulados do finalismo e retira suas consequências para a delimitação do conceito de dolo. Dentre essas consequências, defende que o reconhecimento do dolo eventual na estrutura finalista do delito acontece de forma incoerente, devido, sobretudo, aos postulados que fizeram do finalismo uma das teorias mais aceitas pela doutrina, a saber: o respeito às estruturas lógico-objetiva e a inclusão do dolo no tipo subjetivo.

Background: Clinical and experimental findings have suggested that insomnia is associated with altered emotion processing, such as facial emotion recognition and impairments in executive functions. However, the results still appear non-consensual and have recently been presented by a few number of studies. Accordingly, the aim of the present study was to investigate whether patients with Insomnia disorder will present alterations in recognition of facial emotions and that such alterations will be related to Executive Functions and that Insomnia Disorder patients will (...) exhibit a lower Executive Functions performance when compared to normal controls individuals. Method: A total of 11 individuals diagnosed with insomnia disorder and 15 control participants took part in the present cross-sectional study. They completed questionnaires covering socio-demographic data, a sleep and mood evaluation, and a cognitive assessment. Moreover, they underwent a computerized Facial Emotional Recognition test, consisting of facial emotion labeling and facial emotion matching. Results: Individuals with insomnia presented a lower recognition of facial expressions of fear and sadness in comparison to control volunteers. Perceptual Organization Index was found to be statistically significant lower in the insomnia group compared to the control group. There was a statistically significant association between facial recognition emotional and cognitive processes of in executive functions performance, especially in processes related to the inhibitory control, planning capacity, problem solving and cognitive flexibility in insomnia group. Conclusions: Insomnia disorder impairs the facial emotion recognition of the fear and sadness. Insomniacs with impairment in the facial emotion recognition had impaired performance of executive functions. There is a negative impact on processes related to cognitive-emotional capacity than on processes related to social-emotional recognition. Physiological responses in futsal have not been studied together with temporal information about the players’ stay on the court. The aim of this study was to compare heart rate and blood lactate concentration responses between 1-H and 2-H considering the time of permanency of the players on the court at each substitution in a futsal match. HR was recorded during entire match and [La−] was analyzed after each substitution of seven players. %HRmean and [La−] mean did not differ between 1-H (...) and 2-H. Time in intensity zones of 50–100 %HRmax differed only in 60–70 %HRmax. HR coefficient of variation throughout the match was low and among the four outfield players on the court. Substitutions, time of permanence on the court, ratio between time in- and out-ratio on the court also were similar between 1-H and 2-H. Balancing the number of substitutions, and the In:Outcourt ratio of players in both halves of the match, playing lower time at 1-H, ~8 min for each participation in the match, made it possible to maintain intensity of the match in 2-H similar to the 1H. These results are a good guidance to coaches and for application in future studies. (shrink)

ABSTRACT This article aims to analyze, from a Bakhtinian perspective, the grotesque construction of Mexican artist Frida Kahlo’s body through a religious worldview. Therefore, we analyze two of her self-portraits, taking into account the dialogic relations constructed between the grotesque representations and Catholic symbology. The analyzed utterances, in which the specificities of the creative competence of the author-creator in her aesthetic activity are inferred, showed that a dialogue is established between the painting El venado herido and Catholic Saint Sebastian and (...) between the painting Las dos fridas and the image of the Sacred Heart of Jesus. I argue that the present (if not insuperable) lack of fixed standards in philosophy is associated with three barriers to philosophical progress, pertaining to intra-disciplinary siloing, sociological rather than philosophical determinants of philosophical attention, and the encouraging of bias.

Do component forces exist in conjoined circumstances? Cartwright (1980) says no; Creary (1981) says yes. I'm inclined towards Cartwright's side in this matter, but find several problems with her argumentation. My primary aim here is to present a better, distinctly causal, argument against component forces: very roughly, I argue that the joint posit of component and resultant forces in conjoined circumstances gives rise to a threat of causal overdetermination, avoidance of which best proceeds via eliminativism about component forces. A secondary (...) aim is to show that rejecting component forces does not require, pace Cartwright, rejecting certain attractive theses about what laws of nature express and the role such laws play in scientific explanations. Let us begin with the simple observation that applied mathematics can be very tough! It is a common occurrence that basic physical principle instructs us to construct some syntactically simple set of differential equations, but it then proves almost impossible to extract salient information from them. As Charles Peirce once remarked, you can’t get a set of such equations to divulge their secrets by simply tilting at them like Don Quixote. As a consequence, applied mathematicians are often forced to pursue (...) roundabout and shakily rationalized expedients if any useful progress is to be made. Often these provisional and quasi-empirical procedures within applied mathematics loom large in motivating the “anti-realist” or “anti-unificationist” conclusions of Nancy Cartwright and allied authors. The excellent article in the January number of the Classical Quarterly upon a mistaken interpretation of Philebus 31 c contains the somewhat incorrect statement that this interpretation is the general one: and the article itself is anticipated by a short note in a paper which I published in the Transactions of the Oxford Philological Society for 1881–2. I have nothing to complain of, for it may partly serve me right. Besides, my paper, though duly registered in the Revue de Philologie, (...) is omitted from the index of that periodical; the aforesaid Transactions are out of print, and by some mischance my correction of the wrong rendering did not appear in the last edition of Jowett's Plato, though Jowett intended it should. This article investigates the existence of an original Brazilian legal culture. It parts from a critical examination of the key moments in the history of Brazil through the accounts of its most important scholars, such as Caio Prado Júnior, Darcy Ribeiro, Sérgio Buarque de Holanda, Wilson Martins, Oliveira Viana, Roberto Damatta, José Murilo de Carvalho, among others. It identifies in the Brazilian legal culture something one might call tradition of exception, which can be found in many of its most (...) prominent aspects, such as the persistent denial of any general or abstract regulatory standards, the uncritical introduction of foreign doctrines and legal patterns, the maintenance of aristocratic traditions in social life and the historical disregard of the Brazilian people as political subject. The article also offers a reflection on the problems and potentials of the current historic moment, in which for the first time Brazilians face the possibility of a genuine cultural emancipation. Commenting on the role of psychoanalysis at the time of the posthuman, Véronique Voruz notes dryly that “posthumanismposthumanism is a discourse that brings people together in a conversation where nobody knows what the other is saying, but everyone believes they understand each other to a sufficient degree for a conversation to take place”. “Posthumanismposthumanism” is both symptom and signifiersignifier and thus organizes a social bondsocial bond, at least between academics where the jouissancejouissance or pleasure of discourse compensates for the lacklack (...) of meaning. This is both fortunate and ironic because one of the features of posthumanismposthumanism is precisely the decline and even absence of traditional forms of social bondsocial bond, that is to say those organized by signifiers. In this era of planetary-scale technology, the social bondsocial bond is pre-eminently mediated by objects organized in informationinformation networks. The posthuman “internet of things” provides the paradigm of communicationcommunication in which everything is “chipped” and rendered equivalent: humans, animalsanimal and machines. All are objects that relay readable datadata leaving open the question of whether there is another face to these objects that is unreadable, and whose register therefore in psychoanalytic terms would not be meaning but jouissancejouissance. DeGrazia argues that post-persons have as much justification in believing that they have higher moral status than persons as persons have in believing that they have higher moral status than animals. DeGrazia's claim presupposes that what Buchanan calls the “moral equality assumption” is false. This article argues that DeGrazia has given us no reason to disbelieve the moral equality assumption. Further, even if DeGrazia's arguments about moral status were sound, it is unclear that his first-order normative claims about how we (...) should weigh human against animal interests would follow. La relación de discrepancia y coincidencia de las causas de muerte entre el diagnóstico clínico y anatomopatológico constituye de forma indirecta un indicador de calidad de la atención médica. Son múltiples los ejemplos de enfermedades descubiertas o esclarecidas gracias a la autopsia, que tiene en la correlación clinicopatológica un basamento fundamental. Se estableció como objetivo de investigación describir los principales vínculos históricos entre las especialidades de medicina interna y anatomía patológica, que tienen como enlace esencial la correlación clínico patológica, atendiendo (...) a que no puede existir contradicción antagónica entre enfermo y enfermedad; la medicina interna y la anatomía patológica no pueden verse aisladas ni separadas. The difference and similarity relationship of death causes between the clinical and anatomy-pathological diagnosis is, indirectly, a medical care quality indicator. Thanks to autopsy, which has the clinical-pathological correlation as a main basis, numerous diseases have been discovered or clarified. Discovering the main historical relations between Internal Medicine and Pathological Anatomy specialties was established as the objective of the research. These specialties have the clinical-pathological correlation as a main link, taking into account that there cannot be a conflicting contradiction between the sick and the disease; Internal Medicine and Pathological Anatomy cannot be seen in an isolated or separate way. As the term regenerative agriculture caught fire in public discourse around 2019, it was promptly labelled a buzzword. While the buzzword accusation tends to be regarded as negative, these widely used terms also reflect an important area of growing public interest. Exploring a buzzword can thus help us understand our current moment and offer insights to paths forward. In this study, we explored how and why different individuals and groups adopt certain key terms or buzzwords, in this case the term (...) “regenerative agriculture”. We used an interpretivist approach to understand how “regenerative agriculture” is being constructed, interpreted, understood, and employed, drawing from 19 semi-structured interviews conducted with farmers, researchers, private companies, and NGO/nonprofits. Several interviewees felt that regenerative agriculture is making an important societal shift in thinking towards addressing major issues like climate change and parity in our food and agricultural systems. However, farmers in particular felt that the term is being greenwashed, coopting the work they do, and even diluting the meaning. We also found that regenerative agriculture is being advanced as mobilizing “win-wins”—for farmers, for consumers, for society—but that this discourse may be veiling the political and economic agendas of the big companies using the term. Our findings further illustrated the debates over standardizing the term regenerative agriculture, with some contending that there should be room for “continuous improvement” but others felt it is meaningless without a definition. This introduction highlights the place of “interest” in Isabelle Stengers's essay “Another Look: Relearning to Laugh” and considers its importance for feminist analyses of the sciences. Claiming that the positive affects have been underemployed in feminist philosophy of science, it is argued that Stengers's essay shows how criticism in the sciences can be re-animated through interest, excitement, and laughter.

A significant criticism of the anthropic principle as a scientific claim is that testable predictions cannot be derived from it. Brandon Carter has argued, however, that the principle can be used to predict on the one hand that the period of time biological evolution is intrinsically likely to require is very large, and on the other that the number of ‘critical steps’ that have occurred in the evolution of life on earth is related to the length of time life can (...) continue to evolve. I attempt to show that neither of Carter's arguments provides a convincing defence of the testability of the anthropic principle. (shrink)

Visual experience is often characterised as being essentially spatial, and auditory experience essentially temporal. But this contrast, which is based upon the temporal structure of the objects of sensory experience rather than the experiences to which they give rise, is somewhat superficial. By carefully examining the various sources of temporal variation in the chemical senses we can more clearly identify the temporal profile of the resulting smell and taste (aka flavour) experiences. This in turn suggests that at least some of (...) the objects of olfactory experience have significant temporal structure, including interactions between odorants and the body’s own sensory systems. This can help to inform our understanding not only of the metaphysics of olfaction, but the temporal structure of sensory processing and experience in other sense-modalities, including vision and audition. This commentary raises three questions about the target article: What are pointers or deictic devices? Why insist on deictic codes for cognition rather than deixis simpliciter? And in what sense is cognition embodied, on this view?

After forty years of legalized abortion in the United States, the results are starting to come in on the impact this “freedom” has had on women. Bearing an immense burden of blood guilt (shared by the men who support abortion), they have grown hardened and even hostile toward motherhood, domesticity, and children.
